Please read these terms carefully before placing an order or using our website. By purchasing from Wave Engines Pty Ltd you agree to the terms set out below.

Definitions

In these Terms and Conditions:

  • "We", "us", "our" refers to Wave Engines Pty Ltd, ABN 74 684 461 023 (ACN 684 461 023), trading from 85 Tope Street, South Melbourne VIC 3205.
  • "You", "your" refers to the customer placing an order or using our website.
  • "Website" means the website operated by us at waveengines.com.au and any associated subdomains.
  • "Products" means any outboard motors, parts, accessories, or other goods listed for sale on our website or in store.
  • "Order" means a request by you to purchase one or more Products from us.
  • "Australian Consumer Law" means Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Acceptance of Terms

By accessing our website, placing an order, or making a purchase from us (whether online or in store), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, together with our Warranty Information and any other policies referenced herein.

If you do not agree to these terms, you must not use our website or place an order with us.

We reserve the right to amend these Terms and Conditions at any time. The version published on our website at the time of your order is the version that applies to that transaction. We recommend reviewing these terms each time you make a purchase.

Orders & Pricing

All prices displayed on our website are in Australian Dollars (AUD) and include GST unless otherwise stated. Prices are subject to change without notice. The price applicable to your order is the price displayed at the time you submit your order.

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion. An order is confirmed when we send you a written confirmation by email. We are not obliged to supply Products until confirmation has been sent.

We make every effort to ensure product descriptions and specifications are accurate, however we do not warrant that all information is free from error. If we identify a pricing error or material inaccuracy in a product listing after your order is confirmed, we will contact you to either:

  • Confirm the order at the correct price or with corrected details; or
  • Cancel the order and issue a full refund of any amount paid.

Stock availability displayed on the website is indicative only. In the event that a Product you have ordered is out of stock, we will notify you promptly and provide options including a backorder, substitution, or full refund.

Note on freight: Freight is calculated automatically at checkout using our flat-rate structure: a flat fee of $220 (inc. GST) applies to orders under $5,000 AUD, and freight is free on orders of $5,000 AUD or more. These rates apply to all Australian states and territories, including regional and remote postcodes, with no additional quote required. See our Shipping Policy for full details.

Payment

Payment is required in full before an order is dispatched, unless a specific credit arrangement has been agreed to in writing by us. We accept the following payment methods:

  • Visa and Mastercard (credit and debit)
  • Direct bank transfer (EFT)
  • EFTPOS and cash (in-store purchases only)
  • Approved finance arrangements (subject to separate finance terms)

For bank transfer orders, goods will not be dispatched until cleared funds have been received. You accept all risks associated with payments made by bank transfer including misdirected payments.

We use secure third-party payment processing services. We do not store credit card details on our systems. By providing your payment details you confirm that you are authorised to use the payment method and that it has sufficient funds.

If a payment is declined or reversed after goods have been dispatched, you remain liable for the full purchase price and any associated recovery costs.

Shipping & Delivery

We ship Products to all Australian states and territories using a flat-rate freight structure: a flat fee of $220 AUD (inc. GST) applies to orders under $5,000 AUD, and freight is free on orders of $5,000 AUD or more. This applies automatically at checkout to all Australian postcodes, including regional and remote addresses. International shipping is not available. Delivery typically takes 2–10 business days from dispatch, depending on your location — see our Shipping Policy for full details. All timeframes are estimates only and we accept no liability for delays caused by third-party freight carriers, weather events, or other circumstances beyond our control.

Risk of loss or damage to Products passes to you upon handover to the freight carrier. We strongly recommend inspecting all deliveries upon arrival. If goods arrive visibly damaged:

  • Note the damage on the delivery docket before signing
  • Take photographs of the damaged packaging and item
  • Contact us within 48 hours at info@waveengines.com.au

Failure to note damage at the time of delivery may affect your ability to make a freight insurance claim. Title to goods passes to you only upon receipt of full payment.

In-store pick-up is available at no additional cost from our South Melbourne store during business hours. We will notify you when your order is ready for collection.

Returns & Refunds

We want you to be satisfied with your purchase. Returns and refunds are handled in accordance with the Australian Consumer Law and the following conditions. Full details are set out in our Returns Policy.

Change of mind: We are not required by law to accept returns for change of mind. Where we agree to accept a change-of-mind return, the following conditions apply:

  • The item must be returned within 30 days of delivery or in-store collection
  • The motor must be unused, uninstalled, never started, and in its original manufacturer packaging with all accessories, manuals, and documentation included
  • You are responsible for all return freight costs
  • Approved change-of-mind returns are resolved by store credit or exchange for a motor of equal or greater value — refunds to the original payment method are not available for change-of-mind returns
  • Items that have been installed, mounted, started, or operated in any way cannot be returned for change of mind

Faulty or incorrectly described goods: If a Product is faulty, damaged, or not as described, you may be entitled to a remedy under the Australian Consumer Law. Depending on whether the fault is minor or major, this may include repair, replacement, compensation, or — for a major failure — a full refund to your original payment method. Please contact us promptly with details and photographs of the issue. Do not attempt to repair or modify the item before contacting us.

Freight costs: Where a return is required due to a fault or our error, we will cover reasonable return freight costs. For change-of-mind returns, return freight is at your cost.

Approved refunds, store credit, or exchanges are processed within 5–10 business days of us receiving and inspecting the returned goods. You will receive email confirmation once your refund or credit has been issued.

Warranty

All new outboard motors sold by us are covered by the relevant manufacturer's limited warranty. Full details of warranty coverage by brand are set out on our Warranty Information page.

The manufacturer's warranty is in addition to, and does not limit, your rights under the Australian Consumer Law. We act as your point of contact for all warranty matters and will liaise with the manufacturer on your behalf.

To maintain the benefit of any extended warranty years, all scheduled servicing must be performed at the intervals specified by the manufacturer, by an authorised dealer, using genuine parts. Failure to service on schedule may reduce or void extended warranty entitlements.

Warranty claims: Contact us at info@waveengines.com.au before attempting any repair. Do not start a motor you believe may have a mechanical fault, as this may worsen the damage and affect your claim.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy that you have under the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

Where the Australian Consumer Law applies, our liability to you for a failure to comply with a consumer guarantee is limited (to the extent permitted by law) to:

  • The replacement of the goods or the supply of equivalent goods; or
  • The repair of the goods; or
  • The payment of the cost of replacing the goods or acquiring equivalent goods; or
  • The payment of the cost of having the goods repaired.

Limitation of Liability

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, our total liability to you for any claim arising out of or in connection with a purchase will not exceed the amount you paid for the relevant Product.

We are not liable for any indirect, special, incidental, consequential, or punitive loss or damage, including but not limited to:

  • Loss of income, revenue, or profits
  • Loss of enjoyment or recreational opportunity
  • Costs of hiring alternative equipment
  • Damage to other property caused by a faulty Product
  • Losses arising from delays in delivery

We do not exclude or limit any liability which cannot be lawfully excluded or limited under the Australian Consumer Law or any other applicable legislation.

Product descriptions, compatibility information, and technical advice provided by our team are given in good faith based on information available at the time. It is your responsibility to verify that a Product is suitable for your specific boat, application, and use. We recommend checking your boat's compliance plate before purchase.

Intellectual Property

All content on our website — including text, images, logos, product descriptions, graphics, and layout — is owned by or licensed to Wave Engines Pty Ltd and is protected by Australian and international copyright law.

You may view and print content from our website for your own personal, non-commercial use only. You must not:

  • Reproduce, republish, or redistribute any content from our website without our written permission
  • Use our name, logo, or branding without prior written consent
  • Scrape, copy, or commercially exploit any part of our website

Brand names, logos, and product images associated with Honda, Tohatsu, Yamaha, and other manufacturers are the property of their respective owners and are used by us solely for the purpose of identifying products we sell.

Privacy

We collect personal information (including your name, contact details, and payment information) for the purpose of processing orders, providing customer service, and communicating with you about your purchase.

We handle your personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). We do not sell, trade, or share your personal information with third parties except:

  • Where necessary to process your order (e.g. freight carriers, payment processors)
  • Where required by law or regulatory authority
  • With your explicit consent

Website Use

Our website is provided for the purpose of browsing and purchasing our Products and obtaining information about our business. You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of others.

You must not:

  • Attempt to gain unauthorised access to any part of the website or its underlying systems
  • Introduce viruses, malware, or other harmful code
  • Use automated means (bots, scrapers) to access or extract content from the website
  • Impersonate any person or misrepresent your affiliation with any person or entity

Our website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of those sites and inclusion of a link does not constitute endorsement.

We reserve the right to suspend or terminate access to our website at any time without notice. We do not warrant that the website will be available at all times or that it is free from errors or viruses.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria for any dispute arising out of or in connection with these terms or any transaction with us.

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

Our failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision or our right to enforce it at a later time.
