Welcome to waveengines.com.au (the "Website"), operated by Wave Engines Pty Ltd (ABN 74 684 461 023, ACN 684 461 023) ("Wave Engines", "we", "us", or "our") of 85 Tope Street, South Melbourne VIC 3205, Australia.
By accessing this Website, browsing our range of outboard motors, creating an account, placing an order, or otherwise using any of our services, you ("you", "the customer") agree to be bound by these Terms & Conditions ("Terms"), together with our Privacy Policy and any other policies referenced here, including our Refund & Returns Policy and Shipping Policy. If you do not agree to these Terms, please do not use this Website.
You must be at least 18 years old and capable of forming a legally binding contract to place an Order. If you create an account with us, you are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account. We take reasonable care to ensure Product descriptions, specifications, images, and pricing on the Website are accurate. However:
Placing an Order through the Website constitutes an offer to purchase, which we may accept or decline. A contract is formed only once we send you an order confirmation. We accept payment via Visa, Mastercard, American Express, bank transfer, EFTPOS, and cash for in-store purchases. Full payment (or an agreed deposit for special-order motors) is required before dispatch unless otherwise agreed with us in writing.
You warrant that any payment details you provide are accurate and that you are authorised to use the chosen payment method. We use third-party payment processors and do not store full card details on our servers.
All prices displayed on the Website are in Australian Dollars (AUD) and include GST where applicable. Our current range spans approximately $967 to $57,440 depending on the motor and horsepower selected. Freight and installation costs are quoted separately and confirmed prior to purchase.
We reserve the right to correct pricing errors at any time. If a Product was purchased at an incorrect price due to a typographical or system error, we will contact you to confirm the correct price or cancel the Order with a full refund.
Shipping is free on orders over $5,000; a flat rate of $220 applies to orders below that threshold. In-store pick-up is also available from our South Melbourne showroom. Full details are set out in our Shipping Policy.
We aim to dispatch Orders within the timeframe stated at checkout or in your order confirmation; delivery timeframes are estimates only and not guaranteed. Risk in the Products passes to you upon delivery to the address you provide. Title in the Products does not pass until full payment has been received.
Outboard motors are freight items and may require kerbside delivery or suitable equipment for unloading at your end; you are responsible for ensuring safe and appropriate access at the delivery address.
Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have Products repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
In addition, all motors we sell are new and carry the relevant manufacturer's warranty. Warranty terms vary by brand and model and are subject to change — please confirm current terms with us at the time of purchase, or see our Warranty Information page. Manufacturer warranty claims are subject to the manufacturer's own terms and typically require logbook servicing at an authorised dealer using genuine parts.
We want you to be completely satisfied with your purchase. Change-of-mind returns are accepted within 30 days of delivery or collection, for new, unused motors in original condition with all original packaging and documentation. Faulty products are handled in line with your rights under the Australian Consumer Law, including repair, replacement, or refund depending on the nature of the fault.
Motors that have been installed, mounted, started, or operated in any way are not eligible for a change-of-mind return. Special-order or non-stocked motors ordered specifically for a customer may also not be eligible for change-of-mind return. Please contact us as early as possible if you need to change or cancel an Order.
You must contact us and receive a Return Authorisation (RA) number before returning any Product. Returns received without a prior RA number may be refused and returned to sender. To initiate a return, email us at info@waveengines.com.au with your order number, a description of the issue, and clear photos of the motor and packaging.
For change-of-mind returns, you are responsible for the cost of return freight. We recommend using a tracked freight service as we cannot accept responsibility for items lost or damaged in return transit. If the return is due to our error or a verified product fault, we will arrange and cover the cost of return freight.
Approved refunds are processed within 5–10 business days of us receiving and inspecting the returned motor, back to your original payment method. You will receive confirmation by email when your refund has been issued. Bank processing times may add an additional 3–5 business days depending on your financial institution.

Where we provide installation or servicing, quotes are estimates based on the information available at the time and may be revised if additional work is identified once the vessel or engine is inspected. We will contact you before carrying out work materially exceeding the original quote. You must ensure the vessel and engine are accessible and safe to work on at the agreed time.
You remain responsible for arranging any third-party surveys, registration, or compliance checks required for your vessel independently of any Services we provide, unless expressly agreed otherwise in writing.
To the maximum extent permitted by law, and subject to the consumer guarantees described in section 8, Wave Engines' total liability arising out of or in connection with these Terms, the Website, or any Products or Services, whether in contract, tort (including negligence), or otherwise, is limited at our option to:
We are not liable for any indirect, special, or consequential loss, loss of profits, loss of use of a vessel, or loss of data arising from your use of the Website or Products, except to the extent such liability cannot be excluded by law.
All content on this Website, including text, logos, images, and graphics, is owned by or licensed to Wave Engines and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent, except for personal, non-commercial use. Manufacturer names, logos, and product imagery (Yamaha, Mercury, Honda, Suzuki, Tohatsu) remain the property of their respective owners.
You agree not to use the Website to: (a) engage in unlawful conduct; (b) attempt to gain unauthorised access to our systems; (c) upload malicious code; (d) scrape or harvest data without permission; or (e) interfere with the proper functioning of the Website. We may suspend or terminate your access if we reasonably believe you have breached these Terms.

We are not liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including natural disaster, shipping or supply chain disruption, manufacturer delay, industrial action, or government restriction.

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia in respect of any dispute arising from these Terms.
